YouTuber Tim Pool has formally filed a lawsuit against Vice President Kamala Harris' presidential campaign over allegations of defamation after the campaign accused Pool of calling for "extrajudicial execution" of former President Donald Trump's political opponents.
In late August, the Harris campaign's X account, @KamalaHQ, shared a clip from a May episode of Pool's podcast Timcast IRL featuring guest Laura Loomer. In the clip, Pool said those in political power who have committed crimes should be investigated, subpoenaed, and held accountable. Toward the end of the clip, Loomer noted those who have committed treason have historically been given the death penalty.
"Trump operatives say their Project 2025 plan is to give Trump total, unchecked legal power so they can jail and execute those who don’t support Trump if he wins," @KamalaHQ captioned their post.
Harris' campaign went on to claim Pool "scrubbed" the video from his YouTube account. However, Pool, who also owns SCNR News, has habitually removed videos from YouTube with references to death out of caution of the platform's terms of service.

Loomer responded to @KamalaHQ and called out falsehoods in the post's caption.
"This is a lie. The words Project 2025 were not mentioned once during this episode," Loomer wrote at the time. "The episode was deleted from YouTube by Tim live on air because I mentioned the punishment for treason per our constitution is DEATH."
Loomer went on to recount Pool's cautionary measures taken when guests make comments that could trigger a strike against his channel.

Earlier this evening, Pool announced he had formally filed a lawsuit against Harris' presidential campaign for defamation and referred to their late-August post as "an egregious and psychotic lie."

"I believe that they know they are lying," Pool said of Harris' campaign, adding the post falsely asserted Pool was a "Trump operative" who supported The Heritage Foundation's Project 2025 plan and sought the imprisonment and execution of those who opposed Trump. "It is so antithetical to my views. It is the exact opposite of what was being said in the video."
The YouTuber went on to say he personally, along with his business, had been impacted by @KamalaHQ's post.
Pool's lawsuit detailed his history as a political commentator and independent journalist who has interviewed current and former United States presidential candidates on all sides of partisan divides, including Marianne Williamson, a Democrat.
The lawsuit also details Pool's history aligning with liberal politics and his previous support for former President Barack Obama's initial run in 2008 and Vermont Sen. Bernie Sanders' 2016 presidential bid.
"If anything, Mr. Pool's worldview is woven together by a common thread: deep skepticism of corporate and state power," reads the lawsuit.
Pool's lawsuit also discusses his opposition to the Global War on Terror and criticism of former President George W. Bush along with his work interviewing protestors in New York City during the Occupy Wall Street movement in 2011.
The lawsuit noted Harris' campaign did not "hedge" their statement nor "couch it as opinion."
"To the contrary, to any reasonable reader, the Harris Campaign was saying that Mr. Pool wants to suspend the Constitution, make President Trump dictator, and use state power to imprison and kill Mr. Pool and President Trump's political opponents," the lawsuit continues. "According to the Harris Campaign then, Mr. Pool's 'plan' is to imitate one of the hallmarks of the most abhorrent, murderous regimes of the past and present."
Pool's lawsuit alleged that the YouTuber has had difficulty booking guests with contrary views, including Democratic politicians and members of Congress because of the Harris campaign's post, arguing "the repetitional harm the Harris Campaign inflicted on Mr. Pool will take millions of dollars to undo."
The lawsuit also mentioned a recent breach in security which may have been inspired by the Harris campaign's post.
"Some crazy guy showed up to one of our properties. I was not there. The report I was given is that police were called, an employee was attacked physically and left injured," Pool said during his show. "This stuff is absolutely insane."
Pool also said that neighbors at one of his properties had reported trespassers.
"Kamala Harris is the Democratic candidate for the presidency who posted on her official campaign's social media platform that I advocated for this," Pool continued. "I am not a Trump operative. I am not part of Project 2025. I have never — never — advocated for the death penalty. I strongly oppose it and passionately argue against it."
The lawsuit also cited an October 2019 post on X, then-Twitter, from Pool saying: "I am anti violence, anti censorship, anti corporatist, against mass centralization of power in any form, against illegal spying and the security state, against racism, against fascism, against war." Pool's lawsuit also notes @KamalaHQ claims to provide "fact checks" on their account, which boasts over 1.3 million followers, though has bore "false witness" against the YouTuber.
The lawsuit alleges Harris' campaign engaged in two counts of libel defamation under West Virginia law and bad faith misconduct. Pool is seeking the retraction of the Harris campaign's post along with an award for all cognizable damages and attorney fees and costs.
