Three Republican state lawmakers are drafting legislation to remove President Joe Biden from several state ballots, according to a Friday Breitbart report.
The move follows Tuesday's decision from the Colorado Supreme Court to remove former President Donald Trump from the state's GOP primary ballot.
Republican state representatives drafting the bills include Pennsylvania Rep. Aaron Bernstine, Georgia Rep. Charlice Byrd, and Arizona Rep. Cory McGarr. Georgia, Arizona, and Pennsylvania are swing states and could stymie President Biden's re-election effort.
The upcoming legislation seeks to combat "lawfare" efforts to remove Trump from state ballots which cite the United States Constitution's "Insurrection Clause" under the Fourteenth Amendment.
“We are joining forces to introduce legislation to REMOVE Joe Biden from the ballot in Georgia, Arizona, and Pennsylvania,” the lawmakers told Breitbart News. “The absurdity of radical Democrat judges removing Donald Trump from the ballot in Colorado will be a stain on the American political system for decades. By their very own interpretation of the law, Joe Biden is 100% not eligible to run for political office.”
“Democrats’ insane justification to remove Trump can just as easily be applied to Joe Biden for his ‘insurrection’ at the southern border and his alleged corrupt family business dealings with China,” they added.
“Colorado radicals just changed the game and we are not going to sit quietly while they destroy our Republic. To be clear, our objective is to showcase the absurdity of Colorado’s decision and allow ALL candidates to be on the ballot in all states,” they lawmakers wrote. “To do that, we must fight back as Republicans against the communists currently running our great country.”
Political strategist Cliff Maloney commented on the three Republican state representative's efforts in a statement to Breitbart.
“While GOP elites are asleep at the wheel, the Democrats are very serious about destroying the American Republic,” Maloney said. “Thank God for patriots like Aaron Bernstine, Charlice Byrd, and Cory McGarr for stepping up to FIGHT back.”
The Colorado Supreme Court ruled 4-3 in favor of removing Trump from the state's Republican primary ballot. The ruling is on hold pending appeal by Trump's team until Jan. 4.
“A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment of the United States Constitution,” reads the Colorado Supreme Court ruling. “Because he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot.”
RealClearPolitics currently shows Trump defeating Biden in a rematch by 2.3 points in aggregate.
