Memo Confirms DHS Secretary Mayorkas Designed Biden's Open Borders Policy

A newly released memo from Department of Homeland Security (DHS) Secretary Alejandro Mayorkas shows that he is the architect of the Biden administration’s border policy, which has facilitated record high illegal migration to the U.S.


The memo, which was obtained by investigative reporter Sara Carter, shows Mayorkas not telling federal authorities to follow the letter of the law in border and immigration enforcement, but instead urges the exercise of “prosecutorial discretion” in choosing which illegal aliens to legally pursue.



Central to his strategy is ensuring that enforcement actions by border and immigration authorities “do not lead to inequitable outcomes.”


Mayorkas told heads of U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), and other agencies that illegal aliens potentially subject to removal “have been contributing members of our communities for years,” stating this should be considered a reason not to deport.


“They include individuals who work on the frontlines in the battle against COVID, lead our congregations of faith, teach our children, do back-breaking farm work to help deliver food to our table, and contribute in many other meaningful ways,” he wrote.


“Numerous times over the years, and presently, bipartisan groups of leaders have recognized these noncitizens’ contributions to state and local communities and have tried to pass legislation that would provide a path to citizenship or other lawful status for the approximately 11 million undocumented noncitizens,” Mayorkas added. “The fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them.”

Mayorkas’ directives appear to potentially be in violation of the U.S. Constitution, as well as numerous federal laws.


The U.S. House of Representatives recently unveiled impeachment articles against Mayorkas, attributing his policies as a primary reason the U.S. has seen more than 8 million illegal border crossings under the Biden administration.

His refusal to obey the law is not only an offense against the separation of powers in the Constitution of the United States, it also threatens our national security and has had a dire impact on communities across the country. Despite clear evidence that his willful and systemic refusal to comply with the law has significantly contributed to unprecedented levels of illegal entrants, the increased control of the Southwest border by drug cartels, and the imposition of enormous costs on States and localities affected by the influx of aliens, [Mayorkas] has continued in his refusal to comply with the law, and thereby acted to the grave detriment of the interests of the United States.
